Wrongful Death at Upstate Hospital
This case was a tough one to work on. Our team met with a mother of an 18-month-old child who was killed while she was a patient at an Upstate hospital. The young girl was sent for an MRI post-surgery, while she was intubated and sedated. At some point during the transport, the hospital staff lost her airway and she tragically died as a result. Fulton & Barr prepared to file suit, but once we placed the hospital on notice both parties agreed to mediate the case where a confidential settlement was the outcome.
