How Does Workers’ Compensation Affect Remote Workers?

A recent survey revealed that 12.7% of employees work completely remotely, with an estimated 32.6 million working remotely by 2025. If you work from home, you deserve the same benefits as those employees who operate primarily out of the office. Unfortunately, challenges arise when attempting to get compensated since you must prove that you were performing job duties at the time of your injury.

If you were injured while working from home, our Greenville workers’ compensation lawyers are prepared to obtain the benefits that you deserve.

Eligibility for Workers’ Compensation as a Remote Worker

Under the South Carolina Workers’ Compensation Law, remote workers are entitled to the same benefits as employees in the workplace. The only requirement is that you were in the scope of your employment when you were hurt. If you were injured while doing some other task at your home unrelated to your job, then your workers’ compensation claim may be denied.

What Benefits Can I Receive Under Workers’ Compensation?

South Carolina workers’ compensation law allows employees to be compensated for lost wages and medical expenses.

Lost Wages

In South Carolina, wage benefits are 66 2/3% of your average weekly wage (AWW) prior to your injury. As of January 1, 2024, the maximum weekly compensation that an employee can receive is $1,093.67. So, for employees who experienced an accident on or after January 1, 2024, they will be unable to recover more than the statutory cap, even if 2/3 of their wages exceeds this amount.

Medical Benefits

Employees are eligible to be reimbursed for medical expenses. If you are receiving temporary benefits, then compensation for your medical bills will last as long as you are unable to work. Before scheduling a doctor’s appointment, contact your employer to make sure that the physician is an authorized provider.

The following types of benefits are available to employees:

What If I Am a Remote Worker Who Has Been Denied Benefits?

If you are a remote worker who has had a workers’ compensation claim denied, our Greenville workers’ compensation attorneys are here to assist you. Our workers’ compensation attorneys will represent you in the course of appealing your claim to the Workers’ Compensation Commission. In the first step of the appeals process, you will request a hearing. This will take place with a single workers’ compensation commissioner. If the single commissioner denies your claim, then you reserve the right to appeal to the full commission.

If the full commission denies your claim, you can file a lawsuit. However, you must file a complaint within 30 days of receiving the full commission’s decision. When you hire our legal team, we will advise you accordingly on your next steps.
